The parts:

Inguru Wines SL with the commercial name “Artean Wines, Escuela de Vino”, from now on “the coordinator”, offers educational wine tourism trips, hereinafter the “trip”, in different Spanish regions with a detailed program referred to “itinerary” of each of them. The guests in each of these trips is called “guest”.

Services:

The coordinator is solely responsible for delivering and coordinating the services and goods specifically described in the itinerary.

The trip has a start and end point indicated in each itinerary, so the coordinator does not assume the responsibility of the cost to get to/from these places. All guests must be +18 years old.

Price, deposits, and payment options:

The price of the trip will be shared with the guest with a clear break down of every service and goods included. Anything not specified in the itinerary, it ́s not included as part of the trip.

The trip will only be confirmed once the coordinator receives the EUR 1,000 deposit per guest. The deposit is non-refundable. The deposit can be paid by using any of these payment options: credit/debit card, transfer, or PayPal.

The remaining balance will be due within 120 days before the start of the trip. The coordinator will send a notification with enough time to complete such payment. If the coordinator does not receive the full payment for the trip before the indicated 120 days, the coordinator may cancel the reservation, and the non-refundable deposit will be kept by the coordinator.

Cancellations and refunds:

If a guest decides to cancel the trip, he/she will need to communicate it to info@arteanwines.com with acknowledgment of receipt.

If the cancellation is done within the 60 to 120 days before the start of the trip, the cancellation fee will be 40%. Cancellations done within 60 to 30 days before the start of the trip will incur in a 65% cancellation fee. Cancellations done with less than 30 days before the start of the trip will incur in a 100% cancellation fee and no refund will be issued.

Cancellations done by the coordinator:

The coordinator reserves the right to cancel the trip at any time prior to departure if, due to force majeure, terrorism, natural disasters, political instability, or other external events it is not viable to operate the planned itinerary. If the coordinator cancels the trip, you can transfer the amounts paid to an alternate departure date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control, refunds will be issued less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred because of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights. If you leave a trip for any reason after it has commenced, the coordinator is not obliged to make any refunds for unused services. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made.

The coordinator reserves the right to slightly modify the itinerary due to external forces. If this is the case, we will notify the guest and deliver a product/service of the same category or higher.

Travel Insurance:

The price does not include any type of travel insurance. The coordinator highly recommends getting a full travel insurance to cover the trip. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of €200,000 for each of the categories of cover. We also strongly recommend it to cover any cancellation, curtailment, personal liability and loss of luggage and personal effects.

Accommodation:

The accommodation offered in the package is for an ensuite double bedroom (a room for every two people). Guest travelling only could choose between sharing the double bedroom with another only traveller or to upgrade into an individual bedroom for a fee explained in the price of the tour.

Food, Wine, and Beverages:

The meals included in the trip are set with a specific menu and number of wines/drinks per person. If any guest decides to order any food/wine beyond what it is included in the itinerary, the guest will have to pay for it on its own expense. If any guest has a food intolerance, he must notify it in advance to the coordinator with at least 30 days before the start of the trip. The coordinator will take these intolerances into account to an extent, so they are satisfied from our side and the provider (restaurant/bar/winery/etc.).

Guest Heath Condition:

Guests with illnesses, handicaps or disabilities cannot join this tour. Guests are responsible for informing the coordinator of possible illnesses, handicaps, or disabilities before paying the deposit by emailing it to trips@arteanwines.com (with acknowledgment of receipt). By accepting these terms and conditions and/ or paying a part or the whole amount of the trip, the guest confirms that he/she does not have any illness, contagious disease such as COVID 19 or disabilities.

In case a guest starts suffering any of these healthy conditions after having paid the deposit, the guest will need to claim his/her travel insurance. The coordinator will not take any type of responsibilities in this regard.

The guest needs to be aware that a light level of fitness is required to join this trip as there will be times where guests will need to walk for 30-45 minutes, use stairs, walk in uneven surfaces, etc.

Responsibilities:

Each guest is solely responsible for complying with the requirements established by the Spanish immigration, health, customs and/or police authorities. In the event of non-compliance with these, the guest agrees to compensate the coordinator for any expenses or fines that may arise from such non- compliance.

The coordinator’s liability will be strictly limited and will not exceed the amounts paid by the guest to the coordinator under the terms of this Agreement. Nevertheless, the coordinator endeavours, to the best of its ability, to provide services and goods of the highest quality to the guests.

The coordinator may reject or revoke the request to participate in the trip, if, in its sole discretion, it considers that any guest is in an unsuitable condition and/or considers that the behaviour of any guest is not suitable for the trip or to continue once the trip has started. Unsuitability may include, but is not limited to any behaviour that, regardless of its cause, is inappropriate or offensive or interferes with the provision of travel services and goods, which may constitute a danger, offense, or embarrassment to any other participant. In such cases, the guest will not get a refund for the trip. If the guest decides not to participate in certain services during the trip or refuses to enjoy any goods included in the trip, no refunds will be made for those unused services or goods.

Any dispute related to the trip, the services and goods, the itinerary and/or these terms and conditions will be governed by the laws applicable in the Spanish State and will be resolved in the Courts and Tribunals located in the city of Bilbao. The claim will be done withing one year after the last day of the trip, renouncing any type of claim after said period.

Generals:

By signing these terms and conditions and/or by paying any amount of the trip, the guest grants the coordinator a worldwide, perpetual, royalty-free and fully paid license to use your photographic, video, or digital image and written comments or feedback about the trip solely for promotional and/or commercial purposes of the coordinator. Any guest who does not wish to have their photograph, video footage or comments/feedback used by the coordinator or named third parties must inform the coordinator in writing no later than the trip start date by email sent to trips@arteanwines.com (with acknowledgment of receipt). In any case, the coordinator complies with the regulations in force in the Spanish State (Organic Law 15/1999 of December 13 on the Protection of Personal Data, Royal Decree 1720/2007 of December 21, which approves the Regulation of development of the Organic Law and other current regulations) on data protection.

The guest also gives the coordinator permission to share their email address with the rest of the group taking part in the same trip. Any guest who does not wish the coordinator to share their email address with the other guests must inform the coordinator in writing at the time the guest makes their reservation for the trip, by email to info@arteanwines.com (with acknowledgment of receipt).
